1. Who we are and acceptance of these Terms

Lula Dream is a brand operated by Swiback Limited, Unit 1603, 16/F, The L. Plaza, 367-375 Queen’s Road Central, Sheung Wan, Hong Kong, trading as Lula Dream. In these Terms, “Lula Dream”, “we”, “us” and “our” mean Swiback Limited.

These Terms govern your access to luladream.com and your purchase of products through the site. By using the site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, do not use the site or place an order.

The site and products are offered only to customers with delivery addresses in the continental United States and the District of Columbia. You must be at least 18 years old and able to enter into a binding contract to place an order.

2. Product information and health information

Lula Dream Sleep Strips are dietary supplements, not medicines. Product information is provided for general information only and is not medical advice. Read the complete physical label, including Supplement Facts, directions, allergens and warnings, before use. The physical label supplied with your tin controls if it differs from website content.

Do not use a product if its packaging seal is damaged or if you have reason to believe it has been tampered with. Consult a qualified healthcare professional before use if you are pregnant, nursing, under 18, taking medication, have a medical condition, are preparing for surgery or have a question about whether the product is appropriate for you. Stop use and seek medical advice if you experience an unwanted reaction.

No site content is intended to diagnose, treat, cure or prevent disease. We do not guarantee that a product will produce a particular result for any individual.

3. Orders, acceptance and availability

An order confirmation acknowledges that we received your request. It does not mean we accepted the order. We may decline, limit or cancel an order before shipment where we reasonably believe there is an inventory error, pricing or listing error, payment issue, address issue, suspected fraud, resale activity, legal restriction or breach of these Terms.

Product availability is not guaranteed. If a product becomes unavailable after your order, we may cancel the unavailable portion and refund the amount paid for it. We may correct accidental pricing, product-description or availability errors before shipment and will give you an opportunity to cancel where required by law.

We may limit purchases to ordinary personal use. You may not buy products for unauthorized resale, export or distribution.

4. Prices, payment and taxes

Prices are displayed in US dollars. Shipping, applicable tax and any permitted promotional adjustment are shown at checkout before you submit an order. We may change prices or offers prospectively. Payment must be authorized at checkout. We use Shopify and its payment providers to process payments and do not ask customers to send card details by email.

5. Shipping, delivery and risk

The Shipping Policy forms part of these Terms. We ship only to eligible addresses in the continental United States and the District of Columbia. Delivery estimates are estimates, not guarantees. We will not state a dispatch period unless we have a reasonable basis for it. If we cannot ship within a disclosed or legally applicable period, we will provide the required delay and cancellation options.

You are responsible for providing an accurate, deliverable shipping address. We are not responsible for loss, delay, additional carrier charges or non-delivery caused by an inaccurate, incomplete or undeliverable address, a customer refusal, or a recipient’s failure to collect a parcel, except where applicable law requires otherwise.

6. Changes, cancellations and refunds

Because orders enter fulfilment quickly, email lula@luladream.com as soon as possible if you need a cancellation or address correction. We will attempt to help while the order has not entered production or fulfilment, but a change or cancellation is not guaranteed. Once an order has been accepted for fulfilment, prepared or shipped, it may no longer be cancellable.

The Refund Policy forms part of these Terms. The 30-day money-back guarantee applies only as stated in that policy. It is a limited first-order commercial guarantee, not a general right to return consumable products after opening or use.

7. Intellectual property and permitted use

The Lula Dream name, logos, designs, website content, images, text and other materials are owned by or licensed to us and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-transferable right to use the site for personal shopping purposes. You may not copy, scrape, reproduce, distribute, exploit, reverse engineer, interfere with or use site materials for a commercial purpose without prior written permission.

8. Reviews and user content

If you submit a review, image, comment or other content, you represent that it is your genuine experience, is accurate to the best of your knowledge, does not violate law or third-party rights, and does not contain confidential information. You grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, adapt, publish and display that content in connection with the brand and site, subject to applicable law and our Privacy Policy.

9. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the site and products are provided on an “as available” basis, except for the express commitments in the Refund Policy. We disclaim implied warranties to the extent permitted by law, including merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by applicable law, Lula Dream and its officers, directors, employees, contractors, suppliers and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, loss of data, loss of goodwill or business interruption arising from the site, products or these Terms. Our aggregate liability for a claim relating to an order will not exceed the amount paid by you for the product giving rise to that claim.

These limitations do not exclude liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence or rights that mandatory law gives you.

10. Governing law and venue

These Terms are governed by the laws of Hong Kong, excluding conflict-of-laws principles. The courts of Hong Kong have exclusive jurisdiction over disputes arising from these Terms or an order, except where mandatory law gives a consumer the right to bring a claim in another forum or prevents this clause from applying.

11. Changes, severability and contact

We may update these Terms prospectively by posting a revised version with an updated effective date. The Terms in force when you place an order govern that order unless a change is required by law. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in force.
